The short answer

Gratuity = (15 × monthly basic ÷ 26) × years of service. On ₹80,000 basic with 12 years, that’s about ₹5.54 lakh — tax-free up to ₹20 lakh. Service over 6 months in the final year counts as a full year, so 12 years 7 months = 13 years.

If your employer has 10+ employees and you’ve completed 5 years of continuous service (4 years 10 months counts in practice).

Is gratuity taxable?

Up to ₹20 lakh is tax-free for non-government employees. Government employees get full exemption.

What if my employer refuses to pay?

File a claim with the Controlling Authority (Assistant Labour Commissioner) in your area — it’s a legal right, not a favour.

Does the 15-day formula ever change?

The Payment of Gratuity Act fixes 15 days’ wages per year (wage month = 26 days). Some companies pay more generously via policy.
